Terms of sale

Placing an order is an offer to buy, which we accept when we confirm and begin making it. Prices are in AUD. We're not currently registered for GST, so no GST is added to your price.

Custom and personalised items are made to your supplied details and approved proof. We're not able to remake at our cost for errors in details you supplied and approved.

Designs we create for a custom job remain our work; you're free to use the finished product as you like — see “Design services” below for the detail.

Additional terms for custom manufacturing

Design services

Where Marked By Hand creates, modifies, redraws or develops artwork, CAD models, vector files, templates or other design work, ownership of all intellectual property remains with Marked By Hand unless otherwise agreed in writing.

Payment for design services grants the customer a licence to use the finished product only and does not transfer ownership of the underlying design files.

Source files, editable files, CAD files, vector files and production files are not included unless specifically stated in writing.

Abandoned orders

Where a customer fails to respond to requests for information, design approval, payment or collection for a period exceeding 60 days, Marked By Hand may consider the order abandoned.

Any deposits paid may be retained to cover materials, labour, administration and storage costs.

Marked By Hand reserves the right to dispose of, recycle, sell or otherwise deal with abandoned goods after providing at least 14 days' written notice to the customer.

Collection of orders

Customers collecting orders are responsible for arranging collection within 30 days of notification that the order is ready.

Marked By Hand may charge reasonable storage fees for orders not collected within this period.

Rush orders

Where a rush fee is charged, the fee applies only to priority production scheduling.

Marked By Hand cannot guarantee shipping carrier delivery times and accepts no liability for courier or postal delays.

Rush fees are non-refundable once production has commenced.

Customer-supplied measurements and specifications

Customers are solely responsible for the accuracy of measurements, dimensions, specifications and information supplied.

Marked By Hand is not responsible for products manufactured in accordance with incorrect information provided by the customer.

Any remake required due to customer error will be treated as a new order and charged accordingly.

Suitability for purpose

Unless expressly stated in writing, products supplied by Marked By Hand are intended for decorative, display, hobby, personalisation or general-purpose use only.

Customers are responsible for determining whether a product is suitable for their intended application.

No representation is made that any product is suitable for structural, engineering, safety-critical, load-bearing, commercial, industrial or life-safety applications unless expressly agreed in writing.

3D-printed product disclaimer

3D-printed products are manufactured using additive manufacturing processes and may contain layer lines, visible seams, minor dimensional variations and cosmetic imperfections.

Mechanical properties may vary based on design, print orientation, material selection, environmental conditions and usage.

Customers acknowledge that 3D-printed products may not perform identically to injection-moulded, machined or commercially engineered products.

Marked By Hand accepts no liability for damage, injury or loss arising from misuse, modification, overloading, improper installation or use outside the intended purpose.

Children's products

Unless specifically advertised and certified otherwise, products supplied by Marked By Hand are not intended for use by infants or unsupervised young children.

Products may contain small parts which could present choking hazards.

Adult supervision is recommended where products are used by children. Customers are responsible for ensuring products are age-appropriate and used safely.

Colour, material and screen variations

Product photographs, renders and digital proofs are provided as a guide only.

Colours may vary between screens, devices, materials, batches and manufacturing processes.

Minor variations in colour, engraving depth, finish, texture, alignment and appearance do not constitute defects.

Limitation of liability

To the maximum extent permitted by law, Marked By Hand's total liability arising from any claim relating to goods or services supplied shall not exceed the amount paid by the customer for the relevant order.

Marked By Hand shall not be liable for any indirect, incidental, special, consequential or economic loss including loss of profits, loss of business opportunity, loss of goodwill or loss of data.

Nothing in these Terms excludes rights that cannot be excluded under Australian Consumer Law.

Indemnity

The customer agrees to indemnify and hold harmless Marked By Hand, its owners, employees and contractors against any claim, liability, loss, damage, cost or expense arising from:

• Customer-supplied artwork or intellectual property;
• Incorrect information supplied by the customer;
• Misuse of products;
• Modification of products after delivery;
• Use of products for purposes not disclosed to Marked By Hand;
• Breach of these Terms and Conditions by the customer.
